Position Summary
The Contract Management / Claims Specialist will provide technical contract-management support for installation and other works contracts associated with the project. The Specialist will review contractual correspondence, claims, variations, extension-of-time submissions, notices, records and supporting evidence, and will prepare objective analyses and recommendations for the Client. All commercial decisions, contractual determinations, approvals and authority to instruct or commit the Client will remain exclusively with the Client and its duly authorised representatives.
Key Responsibilities
- Provide technical contract-management and claims-support services for installation, construction, supply-and-install, commissioning and associated works contracts.
- Establish and maintain a contract-administration framework covering contractual obligations, deliverables, milestones, notices, submissions, approvals, insurances, securities, warranties and key dates.
- Prepare and maintain contract registers, correspondence logs, notice registers, variation registers, claims registers, extension-of-time registers, payment-support records and risk/action trackers.
- Review contract documents, conditions of contract, technical specifications, schedules, bills of quantities, employer requirements and amendments to identify obligations, interfaces and commercial risks.
- Monitor contractor and consultant compliance with contractual procedures, notice requirements, time bars, substantiation obligations and record-keeping requirements.
- Review notices of claim, variation proposals, compensation-event submissions, disruption claims, prolongation claims, acceleration claims and other contractual submissions.
- Assess entitlement, causation, contractual basis, contemporaneous records, programme effects, quantum assumptions and supporting evidence for claims and variations.
- Analyse extension-of-time submissions, including baseline and updated programmes, critical path, delay events, concurrency, mitigation, float, recovery plans and completion forecasts.
- Prepare independent technical evaluations, draft recommendations and decision-support memoranda for the Client without exercising the Client’s contractual or commercial authority.
- Review proposed variations and change requests for scope definition, technical necessity, contractual basis, schedule impact, interfaces, risks and supporting cost information.
- Support the preparation and timely issue of contractual notices, responses, reservations of rights, requests for particulars and formal correspondence for approval by the Client.
- Ensure that site instructions, design changes, technical clarifications, nonconformities, access constraints and other events with potential contractual impact are properly documented.
- Coordinate with project management, engineering, supervision, planning, cost, procurement, HSE and commissioning teams to assemble reliable contemporaneous records.
- Support measurement, progress verification and review of payment-related documentation where required, while ensuring certification and payment authority remains with the Client.
- Review daily reports, site records, meeting minutes, photographs, resource data, delivery records, test records and correspondence to establish event chronologies and evidentiary support.
- Prepare claim chronologies, issue papers, cause-and-effect narratives, contractual matrices and substantiation files for negotiation or dispute support.
- Identify emerging contractual risks and potential claims early, and recommend mitigation, record preservation and procedural actions to the Client.
- Support contract meetings, claim-review meetings, variation negotiations and commercial discussions as a technical adviser to the Client.
- Assist with amicable settlement, dispute avoidance, dispute adjudication, expert review, arbitration or litigation support by organising records and preparing technical analyses.
- Review contractor final-account submissions, outstanding claims, completion records, defects obligations, warranties and close-out documentation.
- Support contract close-out, including settlement status, unresolved issues, final records, release documentation and lessons learned.
- Prepare weekly and monthly contract-management reports summarising notices, claims, variations, EOT matters, risks, decisions required and recommended actions.
- Maintain confidentiality, independence and a clear audit trail for all analyses, recommendations and Client decisions.
- Ensure that no instruction, admission, settlement, determination, variation approval or commercial commitment is issued without the Client’s express authorisation.
Qualifications and Experience
- Bachelor's degree in Engineering, Quantity Surveying, Construction Management, Law or a related field; a Master's degree and/or recognised professional contract-management qualification is preferred.
- Minimum of 10 years of professional experience in international engineering or construction contract management.
- At least 7 years of relevant contract-management experience on power, energy or comparable infrastructure projects.
- Demonstrated experience on at least two comparable projects with individual contract values of at least US$10 million, or projects of equivalent contractual and technical complexity.
- Strong practical experience in claims analysis, variations, extension-of-time assessment, contractual notices, contemporaneous records and dispute support.
- Experience administering or advising on international forms of contract, including FIDIC or comparable EPC, design-build, supply-and-install or works contracts.
- Experience analysing delay, disruption, prolongation, acceleration, concurrency, mitigation and critical-path impacts.
- Experience preparing contractual correspondence, entitlement assessments, claim chronologies, variation recommendations and management reports.
- Experience coordinating with engineers, planners, quantity surveyors, lawyers, contractors, utilities, employers and project-management teams.
- Experience supporting negotiation, dispute avoidance, adjudication, arbitration, expert determination or other formal dispute-resolution processes is desirable.
- Experience in East Africa, Sub-Saharan Africa or internationally financed infrastructure programmes is an advantage.
Technical Competencies
- International construction and engineering contract administration, including FIDIC or comparable contract forms.
- Claims entitlement analysis, contractual interpretation, causation assessment, substantiation and recommendation development.
- Variation and change-control management, including scope definition, impact assessment, records and approval workflows.
- Extension-of-time analysis, critical-path review, delay analysis, concurrency, mitigation, float and recovery planning.
- Contractual notices, time-bar provisions, reservations of rights, correspondence control and audit-trail management.
- Contemporaneous record management, event chronology preparation, evidence preservation and document-control coordination.
- Disruption, prolongation, acceleration and productivity-impact analysis.
- Technical review of payment-support documentation, measurement records, completion status and final accounts.
- Dispute avoidance and support for negotiation, adjudication, expert review, arbitration or litigation.
- Proficiency in scheduling and contract-management tools such as Primavera P6, Microsoft Project, document-management platforms and advanced Excel applications.
- Strong knowledge of project controls, construction sequencing, engineering interfaces, commissioning and contract close-out.
- Excellent analytical writing, negotiation support, stakeholder coordination, presentation and management-reporting capability.
Professional Credentials and Attributes
A recognised professional qualification in contract management, quantity surveying, project management, construction law or dispute resolution is preferred. Membership in a recognised professional institution such as RICS, CIOB, CIArb, PMI or an equivalent body is desirable. The successful candidate will demonstrate independence, sound contractual judgement, analytical rigour, discretion, attention to detail, strong record-management discipline, persuasive writing and the ability to provide balanced recommendations while respecting the Client’s retained commercial and contractual authority.
